Federal Judge Mandates Freedom of Abrego Garcia from ICE Custody
A court has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment lacks lawful basis.
"Since his return from erroneous detention in El Salvador, he has been taken back into custody, again without lawful authority," the judge wrote in her ruling.
The situation stems from a mistaken removal to El Salvador in March, which US authorities later acknowledged was an mistake. After his repatriation to the United States to answer alien smuggling charges, he was held in immigration custody.
In her order, the court pointed out that the authorities does not have a current deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."
Background of the Case
The legal proceedings involve disputed assertions. While the former administration contends that Abrego Garcia is a affiliate of the MS-13 gang, he categorically denies this claim.
He has also pleaded not guilty to the smuggling charges, which are part of a separate criminal case in Tennessee.
Conditions of Release
The judge, who was overseeing his petition to deportation in a federal court, determined that he must now adhere to the conditions of his bond from jail in Tennessee. This order shifts his supervision to the Tennessee court.
This ruling represents a notable turn in a complicated legal battle featuring allegations of wrongful detention and contested criminal associations.
